Misdiagnosis and delayed diagnosis can have life-changing effects. Doctors have a duty of care and if your diagnosis was not accurate and timely then you may have a claim.
Common Errors:
No case is the same but some common errors re-occur. These tend to be a failure to:
- interpret test results accurately
- examine you properly
- refer you to a specialist.
When you visit a doctor you should be confident in their opinion and that any course of treatment is the best course for you. We will demand answers and apologies for their mistakes, as well as assurances the mistakes will not be repeated.
There Are Two Types Of Misdiagnosis
Delayed/Missed/Late Diagnosis
In this scenario your doctor has totally missed your illness or realised very late in the process. You could have been brushed off as a worrier or it could have been put down to stress. Either way they did not investigate properly until they became so bad the symptoms could not be ignored.
Misdiagnosis
You may have been diagnosed with something else in the short term and started to receive treatment for this misdiagnosed illness. This incorrect treatment could make your actual illness worse and do more harm than good.

For Lydia Barnett, Partner:
“After undergoing surgery I was left infertile. I had my initial consultation with Lydia in which she made me feel completely at ease. She understood the physical and psychological implications of my claim. These types of claims can take a long time and I was concerned it would have a big impact on my life. Lydia has always been professional, honest and thoughtful and contacted me only when required. She always got back to me quickly when I have had questions. I cannot recommend Lydia and Coles Miller enough.”

For David Simpson, Partner and Head of the Medical Negligence Department:
“I would like to thank my solicitor David Simpson who helped me prove medical negligence for the apalling care and treatment that my late mum received from her GP practice. I had contacted the public health ombudsman with my complaint and they advised me to find a solicitor. I did some research and emailed Coles Miller and David responded really quickly. He said he could help, and throughout the next 18 months David communicated with me and kept me fully informed of what was happening. The whole experience was straightforward and uncomplicated. David's approach is so person centred and I could tell that he genuinely cared. I was at my lowest point when I lost my mum, her cancer diagnosis was delayed by 10 months despite her and me having multiple contacts with the GP practice about her symptoms. I still find it really difficult to believe that this happened to my mum. David's support really helped me, he took all the pressure off me and achieved a very successful outcome. I wanted justice for my mum and David achieved that. I highly recommend David and Coles Miller. Thank you David your a legend ❤️ .”.png)
For Lydia Barnett, Partner:
“During November 2018, I tripped and fractured my elbow. During my surgery, errors were made resulting in my inability to work due to nerve damage and excruciating pain. I approached Coles Miller following research into local legal experts and they agreed to take on my case on a no win, no fee basis. Lydia Barnett, a Partner at Coles Miller took charge of my case and ably assisted by Genae Clarke worked tirelessly to achieve an amazing result for me. I found Lydia to be extremely professional, knowledgeable, friendly and highly approachable. She kept me fully updated throughout the duration of my case. I wouldn’t want to go through the process again, but if I had to I wouldn’t hesitate to contact Lydia.”
